Hernia Mesh Recall

When you get a hernia, part of your fatty tissues or bowel pushes through the layers of muscle and tendon going up and down your ribs and groin. Abdominal wall hernias often need a surgical solution, which can consist of the use of a hernia mesh to repair the damage.

However, since their introduction in 2005, many synthetic meshes have been rushed to market using the FDA’s 510K clearance process and have been in use without ever having their long-term viability or safety studied properly. Over time, many of these products were quietly removed from the market or recalled, as they have been connected with a number of health problems associated with failure of the hernia mesh. Read on to find out which mesh’s have been recalled, as well as for more information about hernia mesh failure and lawsuits.

If you or a loved one has had a hernia mesh and have suffered complications due to its failure, contact Thompson Law Firm now. When was the Hernia Mesh Recall?

Surprisingly, despite there being thousands of reports of problems with many different types of hernia mesh, only a few of the products have ever been recalled. Most types of mesh are still readily available and on the market today. Notable recalls include the Composix Kugel Patch manufactured by C.R. Bard in 2006 and a 2016 recall of the Ethicon Physiomesh Flexible Composite Mesh, both ordered by the FDA.

Other versions of synthetic meshes remain on sale, both by these manufacturers and others.

What are the symptoms of Hernia Mesh Failure?

There are several signs of failure of an installed hernia mesh, including urinary issues, severe pain, irritable bowel conditions, constipation, fatigue, and fever. If you do experience any of these symptoms, it is important to contact your physician immediately. However, because these issues can occur any time after insertion, with the time frame of failure being from a few days after insertion to a few years, it can be difficult to see the connection at first.

How do I know if my hernia mesh has been recalled?

The FDA website maintains a searchable database of recalled medical devices that you can access here. However, this will not show those that have been voluntarily removed from sale by manufacturers, and so is not a complete list. If you are unsure whether your mesh has been recalled, ask your doctor.

How do I know if I Qualify for a Hernia Mesh Lawsuit?

If you have undergone hernia mesh surgery from June 2008 onwards, and you have experienced complications from that surgery at a later date, you may be eligible for a hernia mesh lawsuit, particularly if your mesh was made by Ethicon, Atrium, or Bard Davol.

Additionally, the statute of limitations for this lawsuit in Arizona expires 3 years from the time you could have reasonably known that your complications came from a failed hernia mesh. In other words, if you had your mesh installed in July 2009, began experiencing complications in November 2011, and determined that your mesh was the cause in January 2012, you would have until January 2015 to file a suit.

If you have questions or doubts about whether you qualify for a hernia mesh lawsuit, contact us , and we can help you figure out whether you have a case.

What Can You Recover in a Hernia Mesh Lawsuit?

Those who file a lawsuit and are awarded a settlement may recover the cost of the medical bills incurred during the treatment and diagnosis of the mesh failure. In addition, they may recover lost earnings from being unable to work, emotional damages, pain and suffering, and other financial costs that have been incurred.
