3M Earplugs Recall

Dual-ended earplugs manufactured by 3M were intended for a wide variety of markets, with commissions by the Defense Logistics Agency for military applications, as well as a commercial version for industrial use.  3M earplugs were issued to millions of American military service personnel between 2002 and 2015 during the global ‘War on Terror’, along with widespread use with factory workers, farmers, mining and construction workers among others. Their goal was to protect the ears of people at risk of hearing constant loud noise in order to prevent hearing issues later in life.

Unfortunately, these earplugs did not work as intended. A design error was found, which exposed the user’s ears to the excessive noise that the company promised the plugs would block. This has caused many of the users of the earplugs to have a range of hearing difficulties from tinnitus to total hearing loss.

Were the 3M Earplugs Recalled?

The earplugs were in military use from 2002 to 2015, and slightly longer for the industrial versions.  In 2015, a new type of earplug, known as version 4, replaced the version 2 product for military use. The new design has fixed the design flaw of the old earplugs that caused the hearing issues. While the new design is different, and despite complaints from both the military and commercial sectors, neither the Defense Logistics Agency nor 3M have ever called for the recall or removal of the version 2 earplugs from use or distribution.

What’s wrong with the 3M earplugs?

The earplug is designed to fit snugly in the ear and protect the user’s hearing against potential damage from the excessively loud noise of gunfire, explosions, construction work and so on. Unfortunately, the design was made a little too short. This allowed the 3M earplug to become loose without the user being aware, meaning they did not block as much noise as they should. The earplugs were in use for 10 years before the design flaw was found.

Which 3M earplugs were defective?

There are two types of earplugs currently under investigation. The first of these defective earplugs were used and commissioned by the military between 2002 and 2015, known as the Combat Arms Version 2 (CAEv2). Each was around an inch long, and had dual tips, one black and one yellow, making them easy to identify.

The second are known as the 3M E-A-R ARC earplugs. They were used for ear protection in industrial and commercial settings. They operate in a similar way to the CAEv2 plugs and have the same problems.

Do I qualify for a 3M Earplug lawsuit?

If you were in the military between 2002 and 2015 and used the CAEv2 3M earplugs, or you have used the 3M E-A-R ARC earplugs, and have since gone on to suffer hearing damage such as tinnitus or loss of hearing, you may be eligible for a 3M earplug lawsuit. You must have been diagnosed with hearing loss, tinnitus, or other hearing issues by a licensed medical practitioner.

While the statute of limitations on this case is 2 years, whether you are eligible for a suit will depend on your individual situation including when you used the earplugs and when you were diagnosed with hearing issues.
